Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the GrowthX website and any related services. By accessing the site or engaging our services, you agree to be bound by these Terms.

Services

GrowthX provides growth strategy, marketing, and analytics services as described in individual statements of work or service agreements. Where those agreements conflict with these Terms, the service agreement prevails for that engagement.

Accounts and responsibilities

You are responsible for the accuracy of information you provide, for maintaining the confidentiality of any account credentials, and for all activity under your account. You agree not to misuse the site — including attempting unauthorized access, scraping at disruptive volumes, or interfering with service availability.

Fees and payment

Service fees, billing cadence, and payment terms are defined in the applicable service agreement. Invoices are due within the period stated on the invoice. Late payments may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law.

Intellectual property

We retain all rights to our methodologies, frameworks, templates, and pre-existing materials. Deliverables created specifically for you under a paid engagement transfer to you upon full payment, except for GrowthX tools and know-how, which remain licensed to you for internal use.

Confidentiality

Each party agrees to protect the other’s confidential information with at least the same care it uses for its own, and to use it solely for the purpose of the engagement. This obligation survives termination for three years.

Termination and liability

Either party may terminate an engagement as set out in the applicable service agreement. Sections titled Fees, Intellectual Property, Confidentiality, and this Limitation survive termination. To the maximum extent permitted by law, neither party is liable for indirect or consequential damages, and each party’s aggregate liability is capped at the fees paid in the twelve months preceding the claim.
